What is the Subsequent Injury Benefit Trust Fund?

SIBTF is a California state fund created under Labor Code §4751 that pays additional disability benefits to workers whose total disability is significantly worse because of a pre-existing condition. It pays the gap between what workers’ comp covered and the worker’s actual combined disability — typically as a monthly check for life.

Who qualifies for SIBTF benefits in California?

You may qualify if you had a pre-existing permanent partial disability or health condition, suffered a subsequent California work injury that caused additional permanent disability of at least 35%, and your combined total disability is at least 70%. Special exception: if the pre-existing condition affects a limb or eye and the new injury affects the opposite body part, as little as 5% disability from the new injury may qualify.

How much money will I get from SIBTF?
